Welcome to Hair Chauffeur ("Hair Chauffeur," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Hair Chauffeur website, mobile application, and related services (collectively, the "Services").
By accessing or using Hair Chauffeur, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. Description of Services
Hair Chauffeur is a delivery and marketplace platform that connects beauty supply stores, customers, and independent delivery drivers. Hair Chauffeur facilitates ordering, delivery coordination, and subscription-based services but does not manufacture or own the products sold by stores.
2. Eligibility
You must be at least 18 years old to use Hair Chauffeur. By using the Services, you represent and warrant that you meet this requirement and have the authority to enter into these Terms.
3. Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate and complete information
- Keep your login credentials secure
- Be responsible for all activity under your account
Hair Chauffeur reserves the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions, Trials, and Billing
a. Subscription Plans
Hair Chauffeur offers subscription-based plans for store partners and other users. Pricing, features, and billing frequency are displayed at the time of signup.
b. Free Trial
Some plans may include a free trial period. At the end of the trial, your account will automatically convert to a paid subscription unless canceled before the trial ends.
c. Auto-Renewal
Subscriptions automatically renew at the end of each billing cycle unless canceled prior to renewal.
d. No Early Cancellation
Once a subscription term begins, it cannot be canceled or refunded before the end of the billing period.
e. Failed Payments
If a payment fails, Hair Chauffeur may suspend or terminate access to the Services until payment is successfully processed.
5. Fees and Payments
All fees are stated in U.S. dollars unless otherwise noted. You authorize Hair Chauffeur and its payment processors to charge your selected payment method for all applicable fees.
All payments are non-refundable, except where required by law.
6. Delivery Services
Delivery services are fulfilled by independent third-party drivers. Hair Chauffeur:
- Does not employ drivers
- Does not guarantee delivery times
- Is not responsible for delays caused by traffic, weather, or incorrect delivery information
Stores are responsible for product accuracy and packaging. Customers are responsible for providing correct delivery details.
7. Independent Contractors
Delivery drivers and certain service providers operate as independent contractors, not employees, partners, or agents of Hair Chauffeur. Hair Chauffeur is not responsible for their actions outside the scope of the Services.
8. Acceptable Use
You agree not to:
- Use the Services for unlawful purposes
- Sell prohibited or illegal products
- Abuse, harass, or threaten drivers, stores, or users
- Attempt to copy, reverse engineer, or replicate the Hair Chauffeur platform
- Misuse data obtained through the Services
Violations may result in immediate termination.
9. Intellectual Property & Non-Compete Protection
All content, branding, software, and technology associated with Hair Chauffeur are the exclusive property of Hair Chauffeur.
Users, partners, and store owners may not:
- Copy or recreate a similar delivery or marketplace platform
- Use Hair Chauffeur's business model, branding, or systems to build a competing service
Violation of this section may result in legal action.
10. Termination
Hair Chauffeur may suspend or terminate your access at any time, with or without notice, for:
- Violation of these Terms
- Fraud or misuse
- Legal or regulatory reasons
Termination does not relieve you of payment obligations already incurred.
11. Limitation of Liability
To the maximum extent permitted by law, Hair Chauffeur shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits or data
- Delays or service interruptions
- Acts or omissions of third parties
Use of the Services is at your own risk.
12. Indemnification
You agree to indemnify and hold harmless Hair Chauffeur from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State in which Hair Chauffeur operates, without regard to conflict of law principles.
14. Changes to These Terms
Hair Chauffeur may update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Services constitutes acceptance of the revised Terms.
